This policy is governed by Chilean Law 19.628 on the protection of private life and by the amendments introduced by Law 21.719, which creates the Personal Data Protection Agency.
2. Data we collect
We process data of the people who contact us or hire our services: visitors who fill in a form on this site, our clients, and the contact people of the companies we work with.
We collect the data you give us directly when you fill in a form, write to us by email, WhatsApp or social media, or hire a service. This may include your name, email address, phone number, company and the content of your query.
We also collect technical browsing data (IP address, device type, pages viewed) through analytics tools, subject to your cookie consent.
When you submit a form we also read your network address, to count submissions and stop automated use. That check does not depend on your cookie consent, because it is what keeps the forms available, and the address never travels in the content of the emails we send.
When you ask us to email you the result of one of our online tools, the personal data map or the technical debt diagnostic, we receive your email address and the answers you marked in that tool, so that we can send it to you.
You give us this data yourself: we do not buy databases and we do not build profiles from third party data. The contact form runs one lookup against the public registry of the Chilean tax authority: when you type a RUT, we confirm there the legal name linked to it, so that we know who we are talking to before we answer you, and if that lookup fails your message is sent anyway. And to check that whoever submits the form is a person and not a program, your network address is verified with the provider that protects us from automated use.
3. Purposes and lawful basis
We process your data for the purposes below, with the lawful basis indicated for each one:
- Respond to your queries and manage the commercial relationship: performance of pre-contractual and contractual measures.
- Verify the data you declare in the form and prepare the answer to your query: performance of pre-contractual measures.
- Send you a report or result you requested from one of our online tools: your consent, given before you submit.
- Deliver and improve our services: performance of the contract and legitimate interest.
- Send communications about our services: your consent, which you can withdraw at any time.
- Protect our forms and tools from automated and abusive use: legitimate interest in keeping the service available.
- Measure whether you open the newsletter emails and which links you click, to know what to write about: your consent when subscribing, which you can withdraw with one click in any email.
- Comply with legal, accounting and tax obligations: compliance with a legal duty.
4. Sharing data with third parties
We do not sell or rent your personal data. We may entrust its processing to the providers that give us services (hosting, email, analytics), who act as processors under our instructions and a duty of confidentiality.
International transfers: our servers are in Finland, in the European Union, and that is where the data of this site and of the systems we operate is hosted. Other providers that give us email and analytics services also process data outside Chile. In all those cases we adopt safeguards so that the processing keeps an adequate level of protection under the applicable rules.
5. Retention
We keep your data only for as long as it is needed to fulfill the purposes described and the applicable legal periods. When it is no longer needed, we delete or anonymize it.
6. Your rights
Chilean law gives you five rights over your personal data (art. 14 ter, letter f), plus three more you can exercise through the same channel:
- Access: find out what data of yours we process.
- Rectification: correct inaccurate or incomplete data.
- Deletion: ask us to erase it.
- Objection: object to a specific processing activity.
- Portability: receive your data in a structured, commonly used format.
- Temporary blocking of the processing while we resolve a substantiated request (art. 8 ter).
- Not to be subject to automated decisions that produce legal effects on you or significantly affect you (art. 8 bis).
- Withdraw the consent you gave, at any time and with no retroactive effect (art. 12, paragraphs 4 and 5).
To exercise them, write to [email protected] describing your request. We answer within the legal deadlines. If you believe your rights were not honored, you can complain to the Personal Data Protection Agency.
7. Automated decisions
We do not make automated decisions about you that produce legal effects or significantly affect you, and we do not build profiles for that purpose. When you submit the contact form, the system puts together an internal summary of your query and gives it a score that tells us in what order to review it: it looks at the format of the RUT and whether its range fits the type of organization you declared, confirms the legal name against the public registry, checks whether your email belongs to the domain of the site you gave, and takes into account the length of your message and whether the timeline and the budget fit together. A person reads that summary before answering you, and none of it is applied on its own.
If that changes, we will state it on this page, together with the logic applied and the consequences foreseen (art. 14 ter, letter l).
8. Security
We apply reasonable technical and organizational measures to protect your data against unauthorized access, loss or alteration, including encryption in transit, access control and periodic review of our practices.
9. Cookies
We use cookies and similar technologies to run the site and, with your consent, for analytics. Your choice is stored in your own browser for 180 days, together with the version of this policy that was in force when you made it. We do not record it in a database and we do not link it to your identity. To change it, open the cookie settings or clear the site cookies from your browser.
10. Changes to this policy
We may update this policy when our practices or the applicable rules change. We publish the version in force on this page, with its date and version number.
